▼ ▼ ▼ The Italian Association of Insurance and Reinsurance Brokers, or AIBA, has greatly considered the vulnerabi- lity of SMEs in recent times. AIBA is the most representative association of insurance brokers with over 1,100 member companies. During the emergency, the liability of small and medium-sized entrepre- neurs has been greatly intensified in the area of employer responsibilities, risks of lawsuits, appropriate mana- gement and administration of com- panies. In terms of employer responsibilities, art. 42 paragraph 2 of the Law-Decree “Cura Italia” has qualified the CO- VID-19 contagion as a work accident. Employer responsibilities must always be identified by obtaining evidence of wilful misconduct or responsibility. At the moment obtaining such evidence appears to be complex.
