28 Italy, unfortunately, is among the countries most exposed to natural disasters, as confirmed by the data of the European Seismic Hazard Model (ESHM20) for seismic risk and the mapping of flood risk required by Directive 2007/60/EC on the assessment and management of flood risk. Within ‘geographical Europe’, several countries such as France, Switzerland, Spain, Iceland, and Turkey have already introduced similar insurance covers some time ago. In Germany, the debate is still ongoing. In Italy, compulsory insurance cover for catastrophic risks was introduced by Law no. 213/2023, art. 1 from c. 101 to c. 113. The regulation, in addition to the criteria for insurability, set 31.12.2024 as the deadline by which the policy had to be taken out, a deadline extended by the ‘milleproroghe’ (i.e. a ‘thousand extensions’) decree to 31 March 2025. Subsequently, the Government extended the deadline for medium, small and micro enterprises, as there was too little time to compare offers from insurance companies. The implementation modalities of the law were subsequently introduced and regulated by Decree No. 18 of 30 January 2025, issued in agreement between the Ministry of Economy and Finance and the Ministry of Enterprise and Made in Italy. Let us go into detail. THE NEW DEADLINES Here are the deadlines based on company size: - large enterprises: deadline confirmed as 31 March 2025, with a 90-day transitional period (until 30 June 2025); - medium-sized enterprises: deadline extended to 30 September 2025; - micro and small enterprises: deadline postponed to 31 December 2025. LEGAL ENTITIES THAT MUST COMPLY WITH THE OBLIGATION Companies with their registered office in Italy and companies with their registered office abroad with a permanent establishment in Italy, are required to be registered in the Commercial Register, with the exception of agricultural companies. ASSETS TO BE COMPULSORILY CONSIDERED FOR INSURANCE PURPOSES Fixed and movable assets corresponding to the fixed assets entered in the balance sheet under Assets, item BII, numbers 1), 2) and 3), used for any reason for the exercise of the business activity, are to be compulsorily considered for insurance purposes, i.e: 1. land and buildings; 2. installations and machineries; 3. industrial and commercial equipment. On the other hand, the following are not subject to the obligation: aree a rischio idrogeologico, sismico o alluvionale. L’Italia, purtroppo, figura tra i Paesi più esposti alle calamità naturali, come confermano i dati dell’European Seismic Hazard Model (ESHM20) per il rischio sismico e le mappature del rischio alluvionale previste dalla Direttiva 2007/60/CE sulla valutazione e gestione del rischio alluvioni. Nell’ambito della “Europa geografica” diversi Paesi come Francia, Svizzera, Spagna, Islanda e Turchia hanno già introdotto da tempo coperture assicurative simili. In Germania il dibattito è ancora in corso. In Italia, l’obbligo di copertura assicurativa sui rischi catastrofali è stato introdotto dalla Legge n. 213/2023, art. 1 dal c. 101 al c. 113. La norma, oltre i criteri di assicurabilità, fissava al 31.12.2024 il termine entro il quale bisognava stipulare la polizza, termine prorogato tramite decreto “milleproroghe” al 31 marzo 2025. Successivamente, il Governo ha prorogato la scadenza relativa alle medie, piccole e micro imprese in quanto il tempo a disposizione per confrontare le offerte delle compagnie assicurative era troppo limitato. Le modalità attuative della legge sono state successivamente introdotte e normate con il Decreto n.18 del 30 gennaio 2025 , emanato di comune intesa tra il Ministero Economia e Finanze e il Ministero Imprese e Made in Italy. Entriamo nel dettaglio. LE NUOVE SCADENZE Ecco le scadenze in base alle dimensioni aziendali: - grandi imprese: scadenza confermata al 31 marzo 2025 con un periodo transitorio di 90 giorni (fino al 30 giugno 2025); - medie aziende: hanno tempo fino al 30 settembre 2025; - micro e piccole imprese: la scadenza è posticipata al 31 dicembre 2025. I SOGGETTI GIURIDICI CHE DEVONO OTTEMPERARE ALL’OBBLIGO Le imprese con sede legale in Italia e le imprese aventi sede legale all’estero con una stabile organizzazione in Italia, sono tenute all’iscrizione nel Registro delle imprese, escluse le imprese agricole. I BENI DA CONSIDERARE OBBLIGATORIAMENTE AI FINI ASSICURATIVI Sono da considerare obbligatoriamente ai fini assicurativi i beni immobili e i beni mobili corrispondenti alle immobilizzazioni iscritte in bilancio sezione Attivo, voce BII, numeri 1), 2) e 3), a qualsiasi titolo impiegati per l’esercizio dell’attività di impresa, ossia: 1. terreni e fabbricati; 2. impianti e macchinario; 3. attrezzature industriali e commerciali.
