TERMINI DI ADEGUAMENTO ALLE PREVISIONI DI LEGGE PER LE IMPRESE SPROVVISTE DI POLIZZA Sulla base delle scadenze fissate dal Governo, le imprese che sono totalmente sprovviste di copertura dovranno provvedere mentre le imprese che hanno già in corso coperture contro tali rischi possono adeguarsi dalla prima scadenza annuale di polizza o dalla prima rata intermedia (semestrale, trimestrale, ecc.). Oltre gli aspetti sanciti dalla norma molti saranno i tecnicismi che le imprese della filiera ascensoristica dovranno prendere in considerazione per la corretta stipula come ad esempio: • la gestione delle immobilizzazioni la cui proprietà è riconducibile a società immobiliari di gruppo o di famiglia; • la verifica sui contratti di locazione in corso in merito all’esistenza di clausole che demandano al locatario la stipula di polizze secondo la legge; • la corretta determinazione delle somme da assicurare tenendo in considerazione gli ammortamenti; • le caratteristiche strutturali e antisismiche degli edifici (cemento armato, legno, metallo, pietra, laterizi, ecc.); • la relativa epoca di costruzione; • le zone geografiche; • ubicazione, piani, altezza e volumetria degli edifici o altri elementi. L’obbligo di assicurazione riguarda tutte le imprese associate che svolgono attività produttiva e che hanno iscritti a bilancio impianti e macchinari e/o attrezzature industriali e commerciali, oltre a terreni e fabbricati di proprietà. Per quanto riguarda i terreni e i fabbricati detenuti in locazione, l’onere dell’assicurazione spetta al proprietario, a meno che non sia specificato diversamente nel contratto di locazione. Di conseguenza, un’impresa di servizi che opera in un edificio/locale in affitto e non ha impianti o macchinari né attrezzature industriali e commerciali, dovrebbe essere esonerata dall’obbligo di assicurazione. Comunque, si raccomanda, di consultare il proprio commercialista per una verifica approfondita sulle attrezzature iscritte a bilancio. L’insieme di tali fattori normativi e tecnici richiede naturalmente il supporto di intermediari assicurativi preparati e pronti a fornire l’adeguato supporto alle imprese per ottenere una copertura congrua alle esigenze e al rischio e ai costi sostenibili per l’impresa. *Owner C.A. COMPLIANCE DEADLINES FOR COMPANIES WITHOUT A POLICY Based on the deadlines set by the Government, companies that do not have any coverage at all will have to comply, while companies that already have coverage against such risks can comply from the first annual policy expiry date or from the first interim instalment (half-yearly, quarterly, etc.). In addition to the aspects sanctioned by the regulation, there will be many technicalities that companies in the lift industry will have to take into account for the correct stipulation such as: • the management of fixed assets owned by group or family real estate companies; • checks on current lease contracts for the existence of clauses requiring the lessee to take out policies in accordance with the law; • the correct determination of the sums to be insured taking depreciation into account; • the structural and earthquake-resistant characteristics of the buildings (reinforced concrete, wood, metal, stone, brick, etc.); • the relative age of construction; • the geographical areas; • location, floors, height and massing of buildings or other elements. The insurance obligation applies to all member companies that carry out production activities and have plant and machinery and/or industrial and commercial equipment, as well as owned land and buildings, on their balance sheet. With regard to leased land and buildings, the burden of insurance lies with the owner, unless otherwise specified in the lease agreement. Accordingly, a service enterprise operating in a rented building/building and having no plant or machinery or industrial and commercial equipment should be exempt from the insurance obligation. It is recommended, however, to consult with one’s accountant for a thorough check on the equipment on the balance sheet.
