I relativi oneri, decisamente contenuti, sono tranquillamente condivisibili con il committente/proprietario, in quanto tutela innanzitutto lui e poi gli ambienti di sua proprietà nei quali si eseguono i lavori. Inoltre, gli ascensori sono impianti complessi, dotati di componenti meccanici, elettromeccanici, strutturali, elettrici, elettronici e cristalli; alcuni di questi sono suscettibili di danno e, in caso di incidente durante un intervento di ammodernamento, possono generarsi costi ingenti. Si riporta di seguito qualche evento realmente accaduto (fonte: banca dati sinistri C.A. Broker Srl). CASO 1 - GUASTO ELETTRICO DURANTE LA SOSTITUZIONE DEL QUADRO DI MANOVRA Un installatore stava testando la funzionalità del quadro di manovra di un ascensore in un condominio adibito sia ad abitazioni sia a uffici. Durante una prova funzionale si è verificato un cortocircuito che ha danneggiato: • la nuova apparecchiatura; • la nuova linea elettrica dell’impianto; • la linea preesistente del fabbricato. Inoltre: • è scaturito un incendio nel vano tecnico e negli ambienti attigui; • i fumi maleodoranti propagatisi negli ambienti e il danneggiamento all’impianto elettrico hanno creato intralci alle unità circostanti, con conseguente interruzione di attività per svariati giorni. La polizza CAR/EAR – coprendo il danno diretto, i costi di ripristino e i danni da interruzione di attività – ha evitato all’impresa un esborso imprevisto per decine di migliaia di euro. CASO 2 – DANNI AL VANO CORSA DURANTE UN’OPERAZIONE DI SMONTAGGIO Durante la sostituzione di una vecchia cabina in un palazzo storico tutelato dalla Soprintendenza ai Beni Culturali, uno dei tecnici ha manovrato erroneamente i sistemi di fissaggio del contrappeso, provocandone il distacco con conseguente caduta nel vano e danneggiamento della muratura sia del vano che del solaio. Al di sotto del solaio vi erano antiche volte “a botte” sotterranee, anch’esse lesionate. Il vincolo delle Belle Arti ha compromesso le ordinarie modalità di consolidamento, generando costi aggiuntivi per l’individuazione di imprese edili specializzate, per l’intervento di professionisti e progettisti e per lo svolgimento di un lavoro straordinario. La polizza CAR/EAR ha coperto i danni all’opera preesistente e tutte le maggiori spese, i costi e gli oneri consequenziali, rendendo più agile il ripristino e includendo voci di danno che non sempre rientrano nelle generiche polizze RC terzi. CASO 3 – INFORTUNIO ALL'OSPITE DI UN CONDÒMINO CHE ATTRAVERSA IL CANTIERE Un ospite di un condòmino, durante l’uso delle scale, è scivolato su residui di lavorazione presenti sulle stesse. Furthermore: • A fire broke out in the machine room and adjacent areas. • The foul-smelling smoke that spread throughout the premises and the damage to the electrical system caused disruption to be neighbouring units, resulting in a suspension of activities for several days. The CAR/EAR policy – covering direct damage, restoration costs and business interruption losses – spared the company an unexpected outlay of tens of thousands of euros. CASE 2 – DAMAGE TO THE LIFT SHAFT DURING DISMANTLING WORK During the replacement of an old lift car in a historic building protected by the Superintendency for Cultural Heritage, one of the technicians mishandled the counterweight’s fixing systems, causing it to detach and subsequently fall into the shaft, damaging the masonry of both the shaft and the floor slab. Beneath the floor slab were ancient underground barrel vaults, which were also damaged. The Fine Arts restrictions compromised the standard consolidation procedures, generating additional costs for identifying specialist construction firms, for the involvement of professionals and designers, and for carrying out overtime work. The CAR/EAR policy covered the damage to the existing structure and all major expenses, costs and consequential charges, streamlining the restoration process and including items of damage that do not always fall within the scope of standard third-party liability policies. CASE 3 – INJURY TO A RESIDENT’S GUEST WHILE CROSSING THE BUILDING SITE A guest of a resident slipped on construction debris on the stairs whilst using them.
