The person in charge of maintenance must, at least twice a year for lifts of categories A, B and E and once a year for lifts of categories C and D, check the metal ropes thoroughly, check for breaks in the wires of the ropes themselves and the proper functioning of the safety and con- trol devices as well as the state of insulation of the electrical system and the effectiveness of the electrical connections with the ground, reporting the result of these checks in the prescribed booklet as established by law “. In this quick over- view of the Italian legislative evolution relating to lifts, we cannot fail to mention Decree 1497 of 1963. Reading the first articles of Presidential Decree 1497/63, one immedi- ately perceives that the structure is much more “modern” compared with Legislative Decree 600. Following the defini- tion of the scope and categories (the same indicated by Leg- islative Decree 600), the definitions are introduced (which had not been included in the DL 600). It was also specified that a category B lift could only be used for the transport of people employed by the user company and that a freight el- evator was defined by having a cabin not accessible to peo- ple, and therefore belonging to category D, when the lower edge of the loading openings were at a height of at least 0.80 m from the floor and the cabin had a free height of at least 1.20 m or was equipped with fixed intermediate guards, ex- tended to the entire section of the cabin, such that the result- ing free space was under 1.20 m in height. Finally, the load bearing capacity of a category D freight lift could not be over 250 kg. The 88 articles of the decree were divided into six Chapters, based on the topics. The same considerations made for DL 600/45 apply to DPR 1497/63 regarding the evolution of technical requirements. It must be noted that Presidential Decree 1497/63 introduces an interesting theme related to the adaptation of existing lifts (Chapter VI, Articles 84 to 88). This aspect of the adaptation of pre-exist- ing lifts to the requirements of the new provisions, which we could also indicate as raising the safety level of existing sys- tems was upheld until 1987 (with the Ministerial Decree 587/87 Annex II) but then culpably ignored. Technological evolution leads in a short time to the advent of hydraulic lifts and this inevitably involves the issue of a legislative text that takes into account the particularity of these systems. Hence the Ministerial Decree 1635 of 28/05/1979 (Hydrau- lic lifts) - Replacement safety measures for screw, rack and pinion and hydraulic lifts and hoists. This decree also pro- vides for the adaptation of pre-existing hydraulic lifts through art. 4 of Ministerial Decree 1635/79 Rules for the adaptation of preexisting hydraulic systems which estab- lished the following: “Art. 4. To lifts and hydraulic freight lifts tested before resolution no. 760625/383 indicated above, shall apply the rules contained in the decree of the President of the Republic of 29 May 1963, n. 1497, within the limits to the articles and prescriptions indicated below, with the exceptions and variants also specified, elaborated by the specific study commission of the C.N.R. with resolu- tion no. 780614/385 referred to in the premises”. manutenzione degli ascensori o dei montacarichi, che a nor- ma di legge deve servirsi di personale munito di certificato di abilitazione, deve provvedere alla periodica lubrificazione ed alla verifica di tutto il sistema e promuovere in tutti i casi la tempestiva esecuzione delle riparazioni e la sostituzione di qualsiasi parte deteriorata, mediante comunicazione scritta al proprietario dello stabile. L’incaricato della manutenzione deve, almeno due volte l’anno per gli ascensori di Categoria A, B e E e una volta l’anno per gli ascensori di Categoria C e D, verificare minutamente le corde metalliche, constatare le rotture dei fili delle corde stesse ed il buon funzionamento degli apparecchi di sicurezza e di controllo nonché lo stato di isolamento dell’impianto elettrico e la efficacia dei collega- menti elettrici con la terra riportando il risultato di tali accer- tamenti sul prescritto libretto stabilito dalla legge”. In questa rapida carrellata sull’evoluzione legislativa in Italia relativa agli ascensori non possiamo non citare il Decreto 1497 del 1963. Leggendo i primi articoli del DPR 1497/63 si percepisce subito che la struttura è molto più “moderna” di quella del DL 600. Dopo la definizione del campo di applica- zione e delle categorie (le stesse indicate dal DL 600), vengo- no introdotte le definizioni (che nel DL 600 non erano state inserite). Veniva, inoltre, specificato che un ascensore di cate- goria B poteva essere adibito anche al trasporto di sole perso - ne addette all’azienda utente e che unmontacarichi si definiva con cabina non accessibile alle persone, e quindi appartenen- te alla categoria D, quando il bordo inferiore delle aperture di carico era ad altezza non minore di 0,80 m dal piano di calpestìo e la cabina aveva un’altezza libera non maggiore di 1,20 m oppure era provvista di ripari intermedi fissi, estesi a tutta la sezione della cabina, tali che gli spazi liberi risultanti erano di altezza non maggiore di 1,20 m. Infine, la portata di un montacarichi di categoria D non poteva essere maggiore di 250 kg. Gli 88 articoli del decreto, sulla base degli argo- menti trattati, erano suddivisi in sei Capi. Anche sul DPR 1497/63 possiamo svolgere le stesse considerazioni effettuate per il DL 600/45 a proposito dell’evoluzione delle prescrizioni tecniche. Faccio solo notare che il DPR 1497/63 introduce un interessante tema, quello relativo all’adeguamento degli ascensori preesistenti (Capo VI, artt. dall’84 all’88). Questo aspetto dell’adeguamento degli ascensori preesistenti alle prescrizioni delle nuove disposizioni, che potremmo anche indicare come innalzamento del livello della sicurezza degli impianti esistenti, è un approccio che è stato sempre mante- nuto fino al 1987 (con l’Allegato II del DM 587/87) ma poi colpevolmente ignorato. L’evoluzione tecnologica porta in breve tempo all’avvento degli ascensori idraulici e ciò com- porta inesorabilmente l’emissione di un testo legislativo che tenga conto della particolarità di tali impianti. Ecco, quindi, il DM 1635 del 28/05/1979 (Ascensori idraulici) - Misure sostitutive di sicurezza per ascensori e montacarichi a vite, a cremagliera ed idraulici.
