53 Meanwhile, Europe is advancing as is the need to guarantee the free circulation of products, by imposing safety rules that are the same in all member states of the then EEC. The first example in Italy in this sense is in 1987: in that year the Ministerial Decree 587 of 09/12/1987 (Electric lifts) was is- sued which concerns the implementation of Directives no. 84/529 / EEC and no. 86/312 / EEC relating to electric lifts. As mentioned, also Ministerial Decree 587/87 deals with the adaptation of pre-existing electric lifts, in particular with art. 5 - Modifications to pre-existing lifts and with An- nex II - Adaptation to pre-existing electric lifts with exten- sion, as applicable, to hydraulic lifts, with the Circular of the Ministry of Commerce and Crafts prot. n. 159350. An- nex I to Ministerial Decree 587/87 - Safety rules for the con- struction and installation of electric lifts, contained the technical rules relating to the design and installation of elec- tric lifts. Once again we witness the evolution of technical rules (which are still mandatory): for example the free space in the headroom and in the pit; according to various ex- perts, much of what is indicated in Annex I to Ministerial Decree 587/87 is affected by experience and competence of the Italian lift industry. Hydraulic lifts follow the same leg- islative evolution of the electric lifts but seven years later, with the DPR 268 of 28 March 1994 (Hydraulic lifts) - Reg- ulation implementing Directive no. 90/486 / EEC relating to the regulation of electric, hydraulic or oil-electric lifts. I remember that in those years, and until 1999, technical regulations were mandatory. Only with the advent in Italy of the “new approach” 95/16 / EC Lifts Directive is the pos- sibility of achieving the Community objectives of free circu- lation of products and the impetus for technological devel- opment actually possible, the latter objective achieved “Art. 4. Agli ascensori e montacarichi idraulici collaudati prima della delibera n. 760625/383 sopraindicata dovranno applicarsi le norme contenute nel decreto del Presidente del- la Repubblica 29 maggio 1963, n. 1497, limitatamente agli articoli e prescrizioni di seguito indicati, con le eccezioni e varianti pure specificate, elaborate dall’apposita commissio- ne di studio del C.N.R. con delibera n. 780614/385 di cui alle premesse”. Intanto l’Europa avanza e cresce la necessità di ga- rantire la libera circolazione dei prodotti, imponendo regole di sicurezza uguali in tutti i Paesi membri dell’allora CEE. Il primo esempio in Italia in tal senso è del 1987: in tale anno viene emanato il DM587 del 09/12/1987 (Ascensori elettrici) che concerne l’attuazione delle Direttive n. 84/529/CEE e n. 86/312/CEE relative agli ascensori elettrici. Come accennato, anche il DM 587/87 tratta dell’adeguamento degli ascenso- ri elettrici preesistenti, in particolare con l’art. 5 - Modifiche agli ascensori preesistenti e con l’Allegato II - Adeguamento agli ascensori elettrici preesistenti con estensione, per quanto applicabile, agli ascensori idraulici, con Circolare Ministero del Commercio e dell’Artigianato prot. n. 159350. L’Allega- to I al DM 587/87 - Regole di sicurezza per la costruzione e l’installazione degli ascensori elettrici conteneva, appunto, le regole tecniche relative alla progettazione e installazione de- gli ascensori elettrici. Si assiste, come di prassi, all’evoluzione delle regole tecniche (ancora obbligatorie): basti pensare agli spazi liberi in testata e in fossa ma, secondo diversi esperti, molto di quanto indicato nell’Allegato I al DM 587/87 risen- te dell’esperienza e competenza dell’industria ascensoristica italiana. Gli ascensori idraulici seguono la stessa evoluzione legislativa degli ascensori elettrici sette anni dopo, con il DPR 268 del 28 marzo 1994 (Ascensori idraulici) - Regolamento recante attuazione della Direttiva n. 90/486/CEE relativa alla
