54 thanks to the flexibility guaranteed by the non-manda- tory nature of harmonized standards published in the Offi- cial Journal of the European Union (GUUE). The Lift Direc- tive 95/16 / EC was implemented in Italy in 1999, with Presidential Decree 162 of 30/04/1999 (date of entry into force on 25/06/1999). This is the “Regulation laying down rules for the implementation of Directive 95/16 / EC on lifts and for the simplification of procedures for granting clear- ance for lifts and freight lifts, as well as the related operating license”. From 1 July 1999, regarding the placing on the market of lifts, it is mandatory to follow Directive 95/16 / EC with all that it entails both for the modification of the certification procedures of the lift, and the validity of the technical requirements contained in the standards prepared by CEN and published by the European Commission in the OJEU. Subsequently we witnessed the publication of a new Directive for lifts, 2014/33 / EU, in turn integrated into Presidential Decree 162/99 through other transposition acts including Presidential Decree 214 of October 5, 2010 - Reg- ulation containing amendments to Presidential decree of 30 April 1999, n. 162, for the partial implementation of Direc- tive 2006/42 / EC relating to machinery and amending Di- rective 95/16 / EC relating to lifts and Decree 23 of 10 Janu- ary 2017 - Regulation concerning amendments to Presidential decree of of 30 April 1999 , no. 162, for the im- plementation of Directive 2014/33 / EU relating to lifts and safety components of lifts as well as for the operation of lifts. In the meantime, even equipment that does not fall within the definition of a lift, but which has always belonged to our sector, such as freights lifts and lifting platforms, antedate the same European path taken by lifts. The first Machinery Directive dates back to 1989 (89/392 / EEC) followed by other versions up to the one in force today, 2006/42 / EC, currently under review. The latest Italian decree to have im- plemented the Machinery Directive is the Legislative Decree of 27 January 2010, no. 17. We swiftly covered 75 years of legislative and technical evo- lution in Italy, during which we witnessed the evolution of the lift but also of man and his changing habits and ways. Anacam’s ongoing mission of informing and training its members through technical-regulatory updating seminars is also aimed at building a safety culture for the benefit of end users and technicians. Solo con l’avvento in Italia del- la Direttiva ascensori del tipo “nuovo approccio” 95/16/CE si ha concretamente la possibilità di centrare gli obiettivi comu- nitari della libera circolazione dei prodotti e dell’impulso allo sviluppo tecnologico, quest’ultimo obiettivo raggiunto grazie alla flessibilità garantita dalla non obbligatorietà delle norme armonizzate pubblicate sulla Gazzetta Ufficiale dell’Unione Europea (GUUE). La Direttiva ascensori 95/16/CE viene re- cepita in Italia nel 1999, con il DPR 162 del 30/04/1999 (data di entrata in vigore il 25/06/1999). Si tratta del “Regolamento recante norme per l’attuazione della Direttiva 95/16/CE sugli ascensori e di semplificazione dei procedimenti per la conces- sione del nulla osta per ascensori emontacarichi, nonché della relativa licenza di esercizio”. Dal 1° luglio 1999 per la commer- cializzazione degli ascensori c’è quindi l’obbligo di seguire la Direttiva 95/16/CE con tutto quello che comporta a livello sia di modifica delle procedure di certificazione dell’ascensore, sia a livello di validità dei requisiti tecnici contenuti nelle norme predisposte dal CEN e pubblicate dalla Commissione Euro- pea sulla GUUE. Successivamente abbiamo assistito alla pub- blicazione di una nuova Direttiva ascensori, la 2014/33/UE, a sua volta integrata nel DPR 162/99 attraverso altri atti di rece- pimento tra cui il DPR 214 del 5 ottobre 2010 - Regolamento recante modifiche al decreto del Presidente della Repubblica 30 aprile 1999, n. 162, per la parziale attuazione della Direttiva 2006/42/CE relativa alle macchine e che modifica la Direttiva 95/16/CE relativa agli ascensori e il Decreto 23 del 10 genna- io 2017 - Regolamento concernente modifiche al decreto del Presidente della Repubblica 30 aprile 1999, n. 162, per l’attua- zione della Direttiva 2014/33/UE relativa agli ascensori ed ai componenti di sicurezza degli ascensori nonché per l’eserci- zio degli ascensori. Nel frattempo, anche le apparecchiature non rientranti nella definizione di ascensore, ma da sempre di competenza del nostro settore come montacarichi e piatta- forme elevatrici, anticipano lo stesso percorso comunitario se- guito dagli ascensori. La prima Direttiva macchine è del 1989 (89/392/CEE) seguita poi da altre versioni fino ad arrivare a quella oggi in vigore, la 2006/42/CE, attualmente in fase di re- visione. L’ultimo decreto italiano ad avere recepito la Direttiva macchine è il decreto legislativo 27 gennaio 2010, n. 17. Ab- biamo velocemente percorso 75 anni di evoluzione legislativa e tecnica in Italia, durante i quali abbiamo assistito all’evolu- zione dell’ascensorema anche dell’uomo, con le sue abitudini e modi di vivere. Il lavoro costante che Anacam compie nell’in- formare e nel formare i propri associati attraverso i seminari di aggiornamento tecnico-normativo è teso anche a costruire una cultura della sicurezza a beneficio degli utenti finali e dei tecnici. Le norme vanno conosciute e comprese per essere applicate o, anche, per scegliere di non applicarle perché so- stituite da una valutazione dei rischi.
