• ha proceduto a istruire e formare il personale sui rischi a cui può incorrere durante l’esecuzione del lavoro; • ha approntato procedure operative specifiche per ogni attività. Esse comprendono gli aspetti di salute e sicurezza sul lavoro, gli aspetti riguardanti l’ambiente con la relativa gestione di smaltimento dei rifiuti, come eseguire il lavoro specifico, di quali attrezzature disporre, di quali strumenti di misura e quali DPI utilizzare e quando. Se questo lavoro coinvolge meno di 5 persone e ha una durata minore di 15 giorni non è richiesta la comunicazione all’Inail di lavoro temporaneo. Se una delle due condizioni non è soddisfatta la comunicazione diventa un obbligo. Se per la riparazione la ditta ricorre al subappalto, deve prima verificare l’idoneità tecnico professionale richiedendo almeno i seguenti documenti: 1. DURC; 2. visura camerale; 3. POS; 4. attestati di formazione; 5. idoneità sanitaria. Si consiglia di vietare il subappalto del subappalto di sola manodopera. Se la riparazione prevede opere edili (rimozione porte di piano, opere di riquadratura conseguenti alla posa delle nuove porte) ma vengono eseguite dalla ditta stessa, non è richiesto il PSC ma il POS. Se la riparazione prevede opere edili tali da dover ricorrere a impresa edile (demolizione plinto sostegno argano, allargamento spallette vano corsa per posa porte di luce maggiore) è necessario che il committente (amministratore o proprietario) nomini un Coordinatore per la Sicurezza, ma solo per la fase di esecuzione e non di progettazione, che avrà il compito di redigere il PSC interfacciandosi con l’impresa e/o le imprese operanti alle quali chiederà il relativo POS (art. 98 D. Lgs. 81/08). Ma il POS che normalmente ci viene richiesto cosa deve contenere? A oggi, con l’esperienza maturata nel tempo, ritengo che un valido documento, riferito all’attività di installazione di un nuovo ascensore presso un cantiere edile, debba contenere: • identificazione dell’impresa e del cantiere; • DURC (Documento Unico di Regolarità Contributiva), iscrizione alla CCIAA, matricola; • elenco del personale che potrebbe essere presente in cantiere; • attestati di formazione e idoneità sanitaria del personale in elenco; • elenco eventuali subappaltatori con descrizione delle fasi di lavoro a loro assegnate; • programma di organizzazione temporale dei lavori; • elenco complessivo delle attrezzature usate con riferimento, ove applicabile, alle loro istruzioni d’uso e ai 41 risks they may incur during the execution of the work; • specific operating procedures have been prepared for each activity.
