PREVENZ IONE d i E l e n a S a n d r i n e l l i TRE CATEGORIE Il regolamento UE n. 2016/425 definisce tre categorie di DPI: - Categoria I, comprende i dispositivi che tutelano dai seguenti rischi minimi: lesioni meccaniche superficiali; contatto con prodotti per la pulizia poco aggressivi o contatto prolungato con l’acqua; contatto con superfici calde che non superino i 50 °C; lesioni oculari dovute all’esposizione alla luce del sole (diverse dalle lesioni dovute all’osservazione del sole); condizioni atmosferiche di natura non estrema. - Categoria II, comprende i rischi diversi da quelli elencati nelle categorie I e III. - Categoria III, comprende i dispositivi che tutelano da rischi che possono causare conseguenze molto gravi quali morte o danni alla salute irreversibili con riguardo a: sostanze e miscele pericolose per la salute; atmosfere con carenza di ossigeno; agenti biologici nocivi; radiazioni ionizzanti; ambienti ad alta temperatura aventi effetti comparabili a quelli di una temperatura dell’aria di almeno 100 °C; ambienti a bassa temperatura aventi effetti comparabili a quelli di una temperatura dell’aria di -50°C o inferiore; scosse elettriche e lavoro sotto tensione; annegamento; tagli da seghe a catena portatili; getti ad alta pressione; ferite da proiettile o da coltello; rumore nocivo (da notare che il regolamento inserisce gli otoprotettori tra i DPI di terza categoria e non più tra quelli di seconda), cadute dall’alto. Rientrano pertanto tra i DPI di terza categoria i dispositivi anticaduta, tra cui le imbracature, le cinture di posizionamento, le funi di collegamento con assorbitore di energia, le funi di collegamento ad Y, i moschettoni, i dispostivi anticaduta retrattili. CONSEGNA La normativa non impone la formalizzazione dell’avvenuta consegna dei DPI, ma è buona norma registrarla, in modo da poterla dimostrare a terzi. La registrazione deve essere effettuata per ciascuna consegna, così da poter dare evidenza di tutte le volte che ciascun DPI è stato consegnato al lavoratore. Nel caso in cui si formalizzasse soltanto la prima consegna, il datore di lavoro potrebbe dimostrare alle autorità che, ad esempio, una volta, dieci anni prima ha consegnato un paio di scarpe antinfortunistiche, ma non può dimostrare di averle successivamente sostituite. Il verbale/registro dovrebbe riportare la data e la persona che ha effettuato la consegna ed essere sempre controfirmato dal lavoratore, in modo che quest’ultimo non possa contestare il fatto di aver ricevuto i DPI previsti. Le registrazioni devono essere conservate, anche dopo aver consegnato un nuovo DPI che sostituisce quello già in uso così da poter eventualmente dimostrare che il lavoratore ha avuto a disposizione i DPI necessari per tutta la durata dell’attività lavorativa presso l’azienda. Fall arrest devices are therefore included among the third category PPE, including harnesses, positioning belts, connecting ropes with energy absorber, Y connecting ropes, carabiners, retractable fall arrest devices. DELIVERY The legislation does not require the formalization of the successful delivery of the PPE, but registration is advisable, so that delivery can be demonstrated to third parties. The registration must be made for each delivery, so that evidence of each delivered PPE can be provided to the worker. In the event that only the first delivery is registered, the employer could prove to the authorities that, for example, once, ten years ago, he delivered a pair of safety shoes, but cannot prove that he subsequently replaced them. The report / register should show the date and the person who made the delivery and always be signed by the worker, so that the latter cannot dispute the fact that he has received the required PPE. The records must be kept, even after delivering a new PPE that replaces the one already in use to demonstrate that the worker has had the necessary PPE available for the entire duration of the work at the company. Delivery can be formalized using paperwork or computerized systems, for example using industrial vending machines.
