Ad esempio, una imbracatura che presenta sfilacciature o tagli deve essere ritirata anche se non ha ancora raggiunto la scadenza; allo stesso modo, l’imbracatura deve essere ritirata se ha raggiunto la scadenza, anche se non presenta danni evidenti. Un elmetto che ha subito un forte urto deve essere sostituito pur essendo stato consegnato da pochi mesi; deve essere sostituito anche se, pur non essendo deteriorato, risulti scaduto. È necessario prestare attenzione al momento della consegna, per evitare di distribuire DPI che, pur non essendo mai stati utilizzati, risultino già scaduti. Ogni riparazione e ogni controllo attuato su un DPI deve essere opportunamente registrato, utilizzando la documentazione fornita dal fabbricante o definita internamente dall’azienda. In occasione dei ritiri per manutenzione o controllo, dovrà essere predisposta la consegna al lavoratore di un DPI sostitutivo o si dovrà evitare di far eseguire l’attività che richiede l’uso di quel DPI. Affinché il DPI possa essere efficace, l’art. 78 del D.Lgs. 81/08 prevede che i lavoratori provvedano alla cura dei DPI messi a loro disposizione e non vi apportino modifiche di propria iniziativa, che al termine dell’utilizzo seguano le procedure aziendali in materia di riconsegna dei DPI e che segnalino immediatamente al datore di lavoro o al dirigente o al preposto qualsiasi difetto o inconveniente da essi rilevato nei DPI messi a loro disposizione. INFORMAZIONI, FORMAZIONE E ADDESTRAMENTO Il datore di lavoro, come previsto dall’art. 77 del D.Lgs. 81/08, rende quindi disponibili al lavoratore informazioni adeguate su ogni DPI - ad esempio rendendo disponibile la nota informativa del fabbricante - e sui rischi dai quali lo protegge, assicura una formazione adeguata e, se necessario, uno specifico addestramento circa l’uso corretto e l’utilizzo pratico dei DPI. L’addestramento pratico si rende obbligatorio per tutti i DPI che appartengono alla terza categoria e per i dispositivi di protezione dell’udito. A differenza della formazione, prettamente teorica, l’addestramento ha carattere pratico e prevede una effettiva esercitazione all’uso del DPI. La durata e la modalità dell’addestramento non sono prefissati e possono variare in relazione alla complessità di utilizzo del dispositivo. Gli interventi di addestramento effettuati devono essere tracciati in apposito registro anche informatizzato (art. 37 del D.Lgs. 81/08). manufacturer, in accordance with the instructions given by the latter.
