36 TRADE CREDIT INSURANCE and legal protection L’ASSICURAZIONE dei crediti commerciali e la tutela legale i rischi che un imprenditore deve affrontare nello svolgimento della propria attività sono molteplici e per alcuni di essi denominati “rischi puri”- come i danni ai beni e alle persone e le responsabilità civili derivanti dallo svolgimento dell’attività - l’assicurazione rappresenta un valido strumento volto a trasferire all’assicuratore le conseguenze economiche di un evento (sinistro). Esistono anche rischi di natura patrimoniale che gravano su importanti componenti del patrimonio d’impresa. Osservando i bilanci delle società si rileva come la somma dei crediti verso i clienti rappresenti nella maggioranza dei casi più della metà del valore patrimoniale dell’azienda, raggiunga frequentemente la totalità e talvolta lo superi. È consigliabile, pertanto, proteggersi dal rischio che questa componente fondamentale del bene aziendale possa essere deteriorata da eventi avversi come i mancati pagamenti dei debitori. Molto spesso l’imprenditore ritiene di conoscere sufficientemente il suo acquirente, tanto da ritenere di essere in grado di prevederne le difficoltà ed evitare in tal modo il rischio connesso alla sua solvibilità. Questo convincimento, sebbene in molti casi possa essere fondato, induce solitamente a due comportamenti opposti: da un lato un eccesso di fiducia, esponendosi al rischio di non essere pagati, dall’altro ad un eccesso di prudenza, rinunciando ad un potenziale affare per il timore di andare incontro ad una perdita. ASSICURAZIONE DEI CREDITI COMMERCIALI In che modo ovviare a tutto ciò? Commercial credit insurance aims to support the entrepreneur’s decisions, both by making use of its own expertise in order to prevent non-payments with adequate knowledge of the reliability (creditworthiness) of the buyer, or by indemnifying the insured for the loss when, despite the competent approach, an insolvency occurs.
