Ogni somma recuperata sarà devoluta integralmente all’assicurato. Ricordiaistics like for bank credit lines), provided that its exposure does not exceed the amount of credit granted. If this were to happen, the amount of sales exceeding the credit limit will not be covered. • In the event of non-payment being reported, the insurer will carry out all the amicable, extrajudicial and judicial actions necessary for the recovery of the outstanding debt. Any sum recovered will be donated in full to the insured. After a suitable period of time (usually five months), the actual loss will be calculated. This will be compensated at the rate of 90% of the amount (the Legislator requires that a portion always remain the responsibility of the insured and this usually stands at 10%) • The insurer usually provides what is known as “absolute first loss” cover. This means that if the definitively calculated loss was greater than the credit line granted, the insurer would still have to indemnify 90% of the credit line, thus renouncing the principle of proportionality which is instead included in many other forms of non-life policies. • The insurance premium is represented by a percentage (rate), the subject of a negotiation, which will be applied to the turnover made in a given period, usually a month or a quarter. • The rate/percentage for calculating the premium is normally applied to the total turnover achieved in Italy and/or abroad, without prejudice to any customer exclusions requested by the insured and accepted by the insurer. • Pursuant to the provisions of the Regulator (IVASS — the Institute for the Supervision of Insurance), the insurance coverage excludes sales made to public entities, associated companies, advance payments and private individuals. CREDIT PROTECTION FOR THE LIFT SECTOR AND LEGAL PROTECTION With reference to this last point and about the merits of accessibility to credit insurance for the lift sector, wemust point out that credits against unit owners within condominiums are unfortunately not “insurable” as they are equated to private individuals. However, we would like to remind you that it is advisable to stipulate a suitable cover of Legal Protection extended to contractual disputes with customers, including condominiums and private individuals, so that the lift operator can defend and assert his rights (and credits…) both in extra-judicial and judicial where necessary! Credit insurance is, on the other hand, a decidedly useful and interesting tool for protecting the lift operator when he sells/installs systems on behalf of industrial, commercial or service customers both in Italy and abroad as well as for manufacturers of systems and components especially when they export their products abroad.
