Fondamentale è la sentenza della Corte di Cassazione n. 7938 del 28/3/2017 che esamina un caso di opposizione del Condominio alla modifica dell’impianto ascensore effettuata su richiesta di una signora ultraottantenne con difficoltà di deambulazione per consentirle l’accesso al piano superattico. La Corte ha affermato che il concetto di disabilità va interpretato in senso ampio, anche alla luce della nuova dimensione che ha assunto il diritto alla salute, così che le disposizioni di legge sull’eliminazione delle barriere architettoniche devono ritenersi applicabili anche a persone che, in condizioni di età avanzata, pur non essendo portatori di handicap, abbiano comunque disagi fisici e difficoltà motorie. Dalla sentenza si evince, inoltre, che la speciale normativa, imperativa e inderogabile, direttamente attuativa dell’art. 32 della Costituzione deve interpretarsi alla luce di una più ampia concezione del diritto alla salute inteso non come mera assenza di malattie, ma come stato di benessere psico fisico più generalmente garantito. Sulla scorta di detta pronuncia sono seguite varie sentenze dei giudici di merito. Il Tribunale di Roma con sentenza n. 22022 del 16/11/2018 si è pronunciato in merito alla domanda di due condòmini che chiedevano fosse riconosciuto loro il diritto di installare l’ascensore nonostante il Condominio si opponesse a tale richiesta per presunta assenza delle condizioni di disabilità. Il Tribunale, accertato che uno dei due condòmini richiedenti era persona affetta da obesità con complicanze artrosiche, ha evidenziato come, anche in assenza di consulenza medica, lo stesso fosse da considerare senz’altro portatore di disabilità ed ha affermato che l’interesse del condòmino all’eliminazione delle barriere architettoniche è un diritto fondamentale costituzionalmente garantito. Il Giudice ha, quindi, riconosciuto il diritto all’installazione dell’impianto ascensore. Il Tribunale di Vicenza con sentenza n. 1370 del 1/7/2021 ha analizzato il caso dell’impugnazione di una delibera assembleare che aveva autorizzato l’installazione dell’ascensore stante la presenza nel condominio di due persone ultrasessantacinquenni e di un’altra che si occupava stabilmente del padre invalido civile ospitandolo per una serie di periodi nella propria abitazione per consentirgli di sottoporsi a cicli di cure nell’ospedale del luogo di ubicazione del condominio. Il Tribunale ha rigettato l’impugnazione, affermando da un lato che le condizioni di disabilità o invalidità fisica in senso proprio possono essere equiparate a quelle dell’età avanzata, d’altro lato che in presenza di particolari esigenze deve essere tutelato altresì il diritto del congiunto disabile non condòmino ad accedere liberamente all’abitazione del nucleo familiare dei parenti anche se ivi non convivente. Il Tribunale di Genova con sentenza n. 2570 del 24/10/2023 ha respinto l’impugnazione di una delibera assembleare che aveva autorizzato l’installazione di un There are numerous rulings on the subject by both the courts of merit and the Supreme Court of Cassation (i.e. the highest court of appeal / the court of last resort in Italy). The Court affirmed that the concept of disability must be interpreted in a broad sense, also in light of the new dimension that the right to health has taken on, so that the provisions of the law on the elimination of architectural barriers must be considered applicable also to persons who, in advanced age, although not handicapped, nevertheless have physical discomfort and walking difficulties. It also follows from the judgment that the special, imperative and mandatory legislation directly implementing Article 32 of the Constitution (‘The Republic protects health as a fundamental right of the individual and an interest of the community, and guarantees free care for the needy’) must be interpreted in the light of a broader concept of the right to health understood not as the mere absence of disease, but as a more generally guaranteed state of psycho-physical well-being. On the basis of this pronouncement, various judgments of the judges of merit followed. The Court of Rome, with judgment no. 22022 of 16/11/2018, ruled on the application of two condominium owners who requested that they be granted the right to install a lift despite the fact that the condominium assembly objected to this request on the grounds of the alleged absence of the conditions of disability. The Court, having ascertained that one of the two petitioners was a person suffering from obesity with arthritic complications, pointed out that, even in the absence of medical advice, he was undoubtedly to be considered a disabled person, and stated that the petitioner’s interest in the elimination of architectural barriers is a fundamental right guaranteed by the Constitution. The judge therefore recognised the right to the installation of the lift. The Court of Vicenza, in judgement no. 1370 of 1 July 2021, analysed the case of an appeal against a resolution of the condominium’s assembly meeting that had authorised the installation of a lift in view of the presence in the condominium of two persons over 65 years of age and another who permanently took care of their father, a disabled person, hosting him for a number of periods in his home to allow him to undergo cycles of treatment in the hospital where the condominium building is located. The Court rejected the appeal, stating on the one hand that the conditions of disability or physical invalidity in the proper sense can be equated with those of advanced age, and on the other hand that in the presence of special needs, the right of the disabled relative who is not a co-owner to freely access the home of the relatives must also be protected, even if he or she does not live there.
