AS OF 1 OCTOBER 2024, A CREDIT LICENCE IS COMPULSORY FOR ALL COMPANIES AND SELF-EMPLOYED PERSONS, INCLUDING LIFT COMPANIES, WORKING ON TEMPORARY OR MOBILE CONSTRUCTION SITES ON 1 October 2024, the ‘Credit-based qualification system for companies and self-employed workers’, also known as the credit licence, came into force, as provided for in the new Article 27 of Legislative Decree No. 81 of 9 April 2008 (Consolidation Act on safety at work) and the implementing decree of the Ministry of Labour and Social Policy. The aim is to strengthen control and supervision at construction sites where the risk to workers’ health and safety is highest. From that date, all companies and self-employed workers - not only those that qualify as construction companies - that ‘physically’ operate on temporary or mobile construction sites are required to possess a credit licence. Sole proprietorships without employees are also considered self-employed. Companies that are obliged to hold a credit licence will have to ensure that their subcontractors working on the construction site (locksmiths, bricklayers, glaziers, etc.) also hold a licence. Excluded from the licence requirement are only those carrying out supplies or services of an intellectual nature (such as engineers and architects) and companies with a SOA1 qualification of level III or higher, regardless of the category they belong to. Foreign companies and self-employed workers must submit via the INL (National Labour Inspectorate) portal a document equivalent to a credit licence issued by the competent authorities (for EU countries) or a document recognised by Italian law (for non-EU countries). In the absence of such documents, foreign companies and self-employed persons are also required to apply for a licence. As far as lift companies are concerned, they are all subject to the new obligation except for those that are exclusively involved in maintenance and never work as subcontractors on temporary or mobile construction sites. Please note that a temporary or mobile construction site is considered to be any place where construction or civil engineering work is carried out (the list is given in Annex X of the Consolidation Act on safety at work). WHERE TO APPLY FOR THE LICENCE From 1 November 2024, the credit licence must be applied for compulsorily online via the INL portal, which can be accessed with SPID (Public Digital Identity System) or CIE (electronic ID card). The licence is issued in digital format. REQUIREMENTS The issuing of the licence is subject to certain basic requirements: 1. Registration with the Chamber of Commerce (attested by self-certification) 2. Compulsory safety training for employers, managers, supervisors, self-employed workers and providers of labour (attested by self-certification) 3. Valid certification of social security contribution regularity (Documento unico di regolarità contributiva - DURC) (attested by self-certification) 4.
