76 il proprietario di un servoscala, dopo aver affrontato una spesa relativamente modesta per l’acquisto, si ritrova gravato da costi aggiuntivi legati alla gestione della pratica di comunicazione al Comune, alla manutenzione semestrale e alle verifiche biennali dell’Ente Notificato, con un esborso complessivo che, in breve tempo, può eguagliare l’investimento iniziale. Consideriamo poi l’obbligo di ottenere il patentino per i tecnici: gli esami necessari per il rilascio, comunque impegnativi, sono incentrati esclusivamente sugli ascensori, ignorando le specificità dei servoscala. Questo porta a una situazione paradossale in cui un manutentore potrebbe essere altamente qualificato per operare sugli ascensori, ma privo delle competenze specifiche per i servoscala. Per un’azienda che si occupa esclusivamente di questi dispositivi, l’obbligo di far certificare tutto il personale con un patentino di questo tipo rischia di offrire un valore aggiunto limitato, rappresentando invece un onere significativo in termini di costi e tempo.Anche la gestione burocratica presenta difficoltà. Spesso si incontrano Comuni che respingono le comunicazioni di messa in esercizio di servoscala e montascale, ritenendo che tali obblighi siano riservati solo agli ascensori. Questo genera inevitabilmente confusione e ritardi. Inoltre, dal punto di vista assicurativo, se la messa in esercizio non avviene nei tempi previsti (60 giorni), la polizza dell’impresa di installazione/manutenzione dei servoscala si trasforma automaticamente e di diritto (1898 c.c.) in parzialmente operante o, in casi estremi, totalmente inoperante. In caso di incidenti, ciò può portare a gravi conseguenze per installatori e manutentori, che rischiano di dover risarcire i danni direttamente. È evidente che servoscala e montascale richiedono un’attenzione specifica. Assimilarli agli ascensori all’interno degli stessi regolamenti penalizza ogni attore coinvolto: produttori, manutentori e clienti finali. È necessario avviare un confronto tra produttori, distributori, installatori e manutentori per proporre modifiche mirate al decreto, con l’obiettivo di: 1. stabilire criteri proporzionati alle peculiarità di servoscala e montascale; 2. riparametrare gli obblighi manutentivi e amministrativi in base al tipo di utilizzo; 3. garantire sicurezza per gli utenti e norme più chiare per i manutentori. In un contesto normativo complesso, la collaborazione è essenziale per semplificare il lavoro degli ascensoristi, fornendo prodotti affidabili e facili da installare, accompagnati da un supporto costante. Bureaucratic management also presents difficulties. One often encounters municipalities that reject the mandatory communication concerning the putting into service of stairlifts, deeming that these obligations are only reserved for lifts. This inevitably leads to confusion and delays. Furthermore, from an insurance point of view, if the communication to the municipality does not take place within the stipulated time (60 days), the insurance policy of the stairlift installation/maintenance company automatically and by right (art. 1898 of the Civil Code) becomes partially operative or, in extreme cases, totally inoperative. In the event of accidents, this can lead to serious consequences for installers and maintainers, who risk having to pay damages directly. It is clear that stairlifts require specific attention. To assimilate them to lifts within the same regulations penalises every actor involved: manufacturers, maintainers and end customers. It is necessary to initiate a discussion between manufacturers, distributors, installers and maintainers to propose targeted amendments to the decree, with the aim of: 1. establish criteria proportionate to the peculiarities of stairlifts; 2. repartition the maintenance and administrative obligations according to the type of use; 3. ensure safety for users and clearer rules for maintenance personnel. In a complex regulatory environment, collaboration is essential to simplify the work of lift operators by providing reliable and easy-to-install products accompanied by constant support.
