36 equipment pursuant to Article 73, paragraph 5); • e-learning is permitted for: o general training of workers; o specific training for low risk only; o managers; o employers; o RSPPs limited to Module A. For refresher courses: • in general, all forms are permitted; however, the specific exclusions provided for in the Agreement remain unchanged (e.g. e-learning is prohibited for supervisors). For RSPPs and ASPPs, the Agreement allows the use of e-learning exclusively for Module A, while Modules B, specialist modules and Module C must be carried out in person or via synchronous videoconferencing. RECOGNITION OF PREVIOUS TRAINING The Agreement regulates the recognition of training credits for: • courses taken pursuant to the State-Regions Agreement of 21 December 2011 for supervisors and managers; • RSPP employers; • RSPP, with the exception of Module C. There is also a specific reference to the training of temporary workers, which is covered by the detailed provisions of the Agreement. ANNEX I | RSPP AND ASPP TRAINING: WHEN AN EDUCATIONAL QUALIFICATION EXEMPTS FROM COURSES The State-Regions Agreement of 17 April 2025 introduces an important clarification on the subject of exemptions from training for RSPP and ASPP, explicitly referring to Annex I, which lists the degree classes valid for the purposes of exemption. In particular, the Agreement establishes that certain university degrees allow exemption from attending Module A and Module B, both common and specialised, as provided for in Article 32 of Legislative Decree 81/2008. These include master’s and specialist degrees in technical fields, including various classes of engineering, as well as degrees under the old system in Engineering and Architecture. The exemption is not automatic for any qualification, but is strictly limited to the classes indicated in Annex I. The Agreement also clarifies that the exemption may also be granted for university master’s degrees, specialisation or advanced courses, provided that the university formally certifies the equivalence of the content and duration with respect to the modules provided. Finally, those who have carried out technical activities in the field of health and safety for at least five years as public officials or public service employees are also exempt from attending modules A, B and C. FORMAZIONE DI GIUSEPPE IOTTI* ANNEX II | WORK EQUIPMENT SUBJECT TO CERTIFICATION: WHAT CHANGES WITH THE NEW AGREEMENT The Agreement reorganises the regulations governing work equipment subject to certification, as referred to in Annex II, and clarifies that certification must be renewed every five years, with a minimum duration of 4 hours, to be carried out with mainly practical content and in person. The distinction between formation and training remains unchanged: for Category III PPE and for work at height, practical training in person is required, which cannot be replaced by distance learning and is not subject to training credits. The new State-Regions Agreement introduces mandatory qualifications for certain machines that were not previously explicitly regulated, adding them to those already provided for. The latter also include those normally used in the lift sector (including forklift trucks and truck-mounted cranes), so our companies should not be affected by these additions. This is not “additional” training on top of the general requirements: the qualification is in addition to the training provided for in Article 37 of Legislative Decree 81/2008 and is intended only for those who directly use equipment that exposes them to particular risks. ANNEX III | THE TRAINING CREDIT SYSTEM: RECOGNISING WHAT HAS ALREADY BEEN DONE The new State-Regions Agreement of 17 April 2025 provides a comprehensive definition of the training credit system, governed by Annex III, which is one of the elements with the greatest practical impact for companies and workers. The stated objective is to avoid unnecessary duplication of training by recognising courses already completed when the content is consistent with that provided for in the new Agreement. The recognition of credits allows for total or partial exemption from course attendance, provided that there is documentary evidence, such as a valid certificate, clearly showing the training course already completed, issued by the training institution. Annex III introduces a clear classification of credits, distinguishing between: • total credit, which entails complete exemption from attendance at the course or refresher training provided for; • partial credit, which recognises part of the training already acquired and requires the missing hours to be made up; • attendance, when no correspondence can be identified between previous training and that provided for in the new Agreement. The credit system applies to all key figures in prevention: workers, supervisors, managers, employers, employers who directly perform the duties of RSPP, RSPP, ASPP and safety coordinators.
