31 the Condominium, having its own assets represented by the sums that flow into the condominium bank account subtracted from the availability of the individual owners, can answer with that money to the obligations contracted by the building manager in the collective interest (Court of Milan 11/21/17, Court of Cagliari 27/2/18, Court of Cassino 27/5/21). In conclusion, therefore, on the basis of recent rulings in this regard, foreclosing the condominium bank account is considered legitimate, which does not interfere with the mechanism of the enforcement benefit provided for by the aforementioned art. 63 placed to oversee only the distinct pro-rata obligations due to individuals. This form of execution is faster and facilitates debt recovery against the Condominium. LIFT SHUTDOWN The lift shutdown is not a tool that can be used by the maintenance company to obtain payment of the debt accrued by the Condominium. The lift maintenance service is, in fact, considered essential to protect the primary rights of individuals, consequently the correct functioning must be guaranteed. Furthermore, providing for the shutdown of the lift in the event of debt and therefore conditioning the activation of service to duly paid fees is comparable to a form of self-protection not permitted in our legal system. The lift can only be stopped for safety reasons. The art. 15 of Presidential Decree 20/4/1999 n. 162, which governs the legislation relating to the lift maintenance, in fact clearly establishes that “in the event that the maintenance technician detects a danger in progress, he must stop the system until it has been repaired, promptly informing the owner or his legal representative and the person in charge of periodic checks, as well as the municipality for any provisions of competence”. Arranging the shutdown of a functioning system for reasons of non-payment of the Condominium is therefore illegitimate and undoubtedly represents a breach by the maintenance company which results in compensation against it. In the event of a shutdown due to non-payment included in the maintenance contract, the clause is undoubtedly to be considered vexatious and is therefore null and void. Detto termine, secondo i giudici, è indice dell’esistenza di una sia pure attenuata forma di soggettività giuridica del Condominio distinta da quella dei singoli condòmini (Cass. 8150/2017). Secondo questa interpretazione il Condominio, avendo un proprio patrimonio rappresentato dalle somme che confluiscono sul conto corrente condominiale sottratte alla disponibilità dei singoli condòmini, può rispondere con lo stesso delle obbligazioni contratte dall’amministratore nell’interesse collettivo (Tribunale di Milano 21/11/17, Tribunale di Cagliari 27/2/18, Tribunale di Cassino 27/5/21). In conclusione, quindi, sulla base delle recenti pronunce al riguardo, si ritiene legittimo il pignoramento del conto corrente condominiale che non interferisce con il meccanismo del beneficio di escussione previsto dal citato art. 63 disp. att. c.p.c. posto a presidio unicamente dei distinti obblighi pro quota spettanti ai singoli. Questa forma di esecuzione è più veloce e facilita il recupero dei crediti nei confronti del Condominio. FERMO IMPIANTO Il fermo impianto non è uno strumento che può essere utilizzato dalla ditta di manutenzione per ottenere il pagamento della morosità maturata da parte del Condominio. Il servizio di manutenzione degli ascensori è, infatti, considerato essenziale e a tutela di diritti primari dei singoli con la conseguenza che il corretto funzionamento degli impianti deve essere garantito. Inoltre, prevedere il fermo impianto in caso di morosità e condizionare quindi la ripresa del servizio al corretto pagamento dei canoni equivale a una forma di autotutela non consentita nel nostro ordinamento. L’impianto può essere fermato solo per motivi di sicurezza. L’art. 15 del DPR 20/4/1999 n. 162, che disciplina la normativa relativa alla manutenzione degli ascensori, stabilisce infatti chiaramente che “nel caso in cui il manutentore rilevi un pericolo in atto, deve fermare l’impianto, fino a quando esso non sia stato riparato informandone tempestivamente il proprietario o il suo legale rappresentante e il soggetto incaricato delle ve-
