rifiche periodiche, nonché il comune per gli eventuali provvedimenti di competenza”. Disporre il fermo di un impianto funzionante per ragioni di morosità del Condominio è pertanto illegittimo e rappresenta senza dubbio un inadempimento della ditta di manutenzione con conseguenti obblighi risarcitori a suo carico. Nell’ipotesi in cui il fermo dell’impianto per morosità sia previsto nel contratto di manutenzione, la clausola è senza dubbio da considerarsi vessatoria ed è quindi nulla. Si suggerisce, pertanto, di eliminarla dai modelli contrattuali. Diversa dal fermo dell’impianto disposto dalla ditta di manutenzione è l’ipotesi dell’inibizione del servizio ascensore da parte dell’amministratore nei confronti di chi non è in regola con il pagamento delle quote, consentita dalla legge. L’art. 63 disp. att. c.p.c. comma 3 stabilisce infatti che “in caso di mora nel pagamento dei contributi che si sia protratta per un semestre l’amministratore può sospendere il condòmino moroso dalla fruizione dei servizi comuni suscettibili di godimento separato”. Molte pronunce hanno, tuttavia, sancito che non possono essere sospesi i servizi primari ed essenziali e che tale deve essere considerato anche il servizio ascensore soprattutto quando vi sono nello stabile persone anziane o disabili. In tal caso prevale il principio di solidarietà condominiale e l’utilizzo dell’ascensore deve essere garantito anche ai condòmini morosi (Tribunale di Roma n. 6353/2020, Tribunale di Roma n. 24892/2015). In ogni caso la sospensione del servizio solo nei confronti dei condòmini morosi - a prescindere dalla sua legittimità - non è una misura che può essere attuata dalla ditta di manutenzione, ma solo dall’amministratore del Condominio a tutela dei diritti dell’ente condominiale al pagamento dei contributi. Lo strumento non appare quindi funzionale allo scopo di ottenere il pagamento dei canoni di manutenzione. Ulteriore diversa ipotesi è quella in cui l’ascensore non è funzionante perché necessita di lavori di riparazione che esulano dalla manutenzione ordinaria. In tal caso è legittimo condizionare l’esecuzione delle lavorazioni e la conseguente rimessa in funzione dell’impianto al pagamento del corrispettivo per le riparazioni, trattandosi di prestazione che non fa parte del servizio di manutenzione previsto nei contratti. Infine, osserviamo che, ovviamente, in caso di perdurante morosità del Condominio, la ditta di manutenzione può attivare i rimedi ordinari previsti dal codice civile e può quindi scegliere di risolvere il contratto per grave inadempimento del Condominio ex art. 1453 e ss. c.c. In tal caso la sospensione del servizio e il relativo fermo impianto sono conseguenza dello scioglimento del rapporto e non della semplice morosità del Condominio e sono quindi legittimi. Ovvio però che detta strada comporta la perdita del contratto e va valutata pertanto da ciascuna ditta nella propria ottica commerciale. In art. 63 in fact, paragraph 3 establishes that “in the event of default in the payment of contributions that has lasted for a semester, the building manager can suspend the defaulting co-owner from the use of common services susceptible to separate enjoyment”. However, many rulings have stated that primary and essential services cannot be suspended and that the lift service must also be considered as such, especially when there are elderly or disabled people in the building. In this case, the principle of condominium solidarity prevails and the use of the lift must also be guaranteed to defaulting co-owner (Court of Rome n. 6353/2020, Court of Rome n. 24892/2015). In any case, service suspension only for defaulting co-owners - regardless of its legitimacy - is not a measure that can be implemented by the maintenance company, but only by the building manager to protect the condominium institution’s rights to payment of contributions. The tool therefore does not appear functional for the purpose of obtaining payment of maintenance fees. A different hypothesis is that in which the lift is not functional because it requires repair work which goes beyond ordinary maintenance. In this case, it is legitimate to condition the execution of the work and the consequent restarting of the plant on the payment of the fee for the repairs, since this is a service that is not part of the maintenance service provided for in the contracts. Finally, we note that, in the event of persistent default by the Condominium, the maintenance company can activate the ordinary remedies provided for by the civil code and can therefore choose to terminate the contract due to serious breach by the Condominium pursuant to art. 1453 et seq. c.c. In this case, the suspension of the service and the relative shutdown of the lift system are a consequence of the dissolution of the relationship and not of mere Condominium debt and are therefore legitimate. However, it is obvious that this path involves the loss of the contract and must therefore be evaluated by each company from its own commercial point of view. INSERTING CLAUSES IN THE CONTRACT To mitigate the negative consequences of non-payment of fees and also to prevent them, an option may be including clauses in maintenance contracts that strengthen the protection of the company in the event of non-payment of the Condominium. It may be envisaged that the non-payment of one or more consecutive overdue periodical fees will in itself result in the legal termination of the contract leading therefore to inserting an express termination clause. This facilitates the company as normally the contract can be terminated only for serious non-fulfilment which could not be recognized in the event of non-payment of one or a few fees.
