Questo argomento rappresenta un “vuoto” non sempre colmabile nelle comuni polizze generiche, quindi diviene indispensabile utilizzare polizze assicurative mirate e specifiche, corredate delle opportune clausole che consentano il corretto trasferimento delle conseguenze del vided for by law, which establishes: a) which damages are to be considered unjust, as they prejudice others’ right; b) to whom they are to be imputed, i.e. who is obliged to compensate or remedy the damage. PRESUMED RESPONSABILITIES It is useful to recall the principle of presumed responsibilities, i.e. those responsibilities for which, in the event of damage, the burden of proof is reversed. That is, it is directly up to the damaging party (the company) to prove that it was not at fault in relation to the damaging event. The first element of presumed liability is related to what is legislated in the area of hazardous activities, i.e. plant engineering activities. Another element of presumptive liability is related to the delivery and/or custody of the installation. It should be remembered that a party other than the damaging party may also be held liable in cases of liability for the actions of others, such as subcontracted activities or solidarity obligations with component manufacturers. WHY LIABILITY COVERAGE IS INDISPENSABLE The above arguments are enough to understand that maintenance company liability cover, while not compulsory in Italy, is indispensable. It must be well structured, comprehensive and up-to-date with all the necessary guarantees. It is important to remember that what is against the law is not insurable and that, even if not expressly mentioned within a policy, all Italian laws are still applicable. This applies, of course, also to current regulations on lift systems or machines such as, for example, DM 37/08 and Presidential Decree 162/99 as amended and/or supplemented by Presidential Decree 23/2017. THE RISKS OF AN INVISIBLE INSTALLATION By virtue of the concept of referral to the law, we cannot in any way overlook the fact that regarding the putting into service there is a prohibition to place or maintain installations for which the owner has not carried out the required notifications to the competent municipality or other relevant territorial body. As is well known, companies often hold maintenance contracts for installations without such administrative regularity, exposing themselves to risks whose consequences go beyond the application of the rule and therefore, by analogy, also outside the perimeter of validity of the insurance cover. This subject represents a ‘gap’ that cannot always be filled in common generic policies, so it becomes indispensable to use targeted and specific insurance policies, accompanied by the appropriate clauses that allow for the correct transfer of the consequences of the risk and that are fully operational in the event of damage. The quality of a policy is not measured by its cost, but by its ability to RISCHI E ASSICURAZIONI DI ANGELO NICOLOSI*
