45 With regard to PPE, the employer’s obligation to maintain the efficiency, hygiene and functionality of the equipment is reiterated, extending the obligation to work clothing that serves as PPE. The rewriting of Article 115 clarifies the hierarchy of measures against falls from height: • priority to collective protection (guardrails, nets); • only if not technically feasible, use of PPE, giving preference to restraint, positioning and fall arrest systems. UNI TECHNICAL STANDARDS: MORE TRANSPARENT ACCESS Decree Law 159/2025 provides for the promotion of agreements between INAIL and UNI to allow free consultation of the technical standards referred to in the decree and of particular relevance to safety. An official bulletin of technical standards is also planned, to be published on institutional websites. This is an important step towards reducing barriers to access to technical standards. SUPERVISION AND CONTROLS: TOWARDS DATA INTEGRATION The decree strengthens coordination between INL (National Labour Inspectorate), INAIL and other bodies, focusing on the interoperability of databases and increasingly targeted supervision. The model that is taking shape is one of controls that are: • less random; • more based on risk indicators; • more oriented towards the overall consistency of the company system. In this scenario, the traceability of skills, attendance and training processes becomes a real defence for structured companies. DPI E LAVORI IN QUOTA: PRIORITÀ ALLE PROTEZIONI COLLETTIVE Sul fronte DPI viene ribadito l’obbligo del datore di lavoro di mantenere in efficienza, igiene e funzionalità i dispositivi, estendendo l’obbligo anche agli indumenti di lavoro che assumono funzione di DPI. Con la riscrittura dell’art. 115, viene chiarita la gerarchia delle misure contro le cadute dall’alto: • priorità alle protezioni collettive (parapetti, reti); • solo se non tecnicamente praticabili, ricorso ai DPI, privilegiando sistemi di trattenuta, posizionamento e arresto caduta. NORME TECNICHE UNI: ACCESSO PIÙ TRASPARENTE Il DL 159/2025 prevede la promozione di convenzioni tra INAIL e UNI per consentire la consultazione gratuita delle norme tecniche richiamate dal decreto e di particolare rilevanza in materia di sicurezza. È previsto anche un bollettino ufficiale delle norme tecniche, da pubblicare sui siti istituzionali. Un passaggio importante per ridurre le barriere all’accesso alle norme tecniche. VIGILANZA E CONTROLLI: VERSO L’INTEGRAZIONE DEI DATI Il decreto potenzia il coordinamento tra INL, INAIL e altri enti, puntando sull’interoperabilità delle banche dati e su una vigilanza sempre più mirata. Il modello che si delinea è quello di controlli: • meno casuali; • più basati su indicatori di rischio; • più orientati alla coerenza complessiva del sistema aziendale. In questo scenario, la tracciabilità delle competenze, delle presenze e dei processi formativi diventa un vero elemento di difesa per le imprese strutturate. LA SFIDA È CHIARA: USCIRE DALLA LOGICA DELL’ADEMPIMENTO MINIMO E COSTRUIRE SISTEMI DI SICUREZZA INTEGRATI, DOCUMENTATI E COERENTI The challenge is clear: to move away from the logic of minimum compliance and build integrated, documented and consistent safety systems
