Among the changes: • introduction of a new type of medical examination (Article 41, paragraph 2, letter e-quater), which can be requested by the competent doctor when there is reasonable cause to believe that the worker is under the influence of alcohol, narcotics or psychotropic substances, limited to activities with a high risk of accidents and solely for the purposes of safety in the performance of the task (until now, in the lift sector, this medical examination was not possible in cases of suspected addiction to narcotic or psychotropic substances, but only for the control of alcohol addiction); • provision, within twelve months, of a decree by the Minister of Health to define the requirements of the facilities that the competent doctor may use; • strengthening of the role of joint bodies, especially for companies with up to ten employees. The decree also reaffirms the central role of the competent doctor and delegates the updating of procedures on alcohol and drug addiction to a State-Regions Agreement. INNOVATION, PPE AND INAIL POLICIES: A CHANGING LANDSCAPE The decree strengthens the role of INAIL not only as an insurance institution, but also as an active player in promoting prevention, providing for: • measures to support micro, small and medium-sized enterprises in adopting innovative PPE and intelligent systems; • resources dedicated to spreading a culture of safety and training in sectors with the highest accident rates. NEAR MISS: NATIONAL GUIDELINES Within six months of the decree coming into force, guidelines must be adopted for the identification, tracking and analysis of near misses for companies with more than 15 employees. The Ministry of Labour will establish the procedures for communicating aggregate data and corrective actions in order to prepare an annual national report. This is an important cultural shift: the focus is shifting from the event that occurred to the risk that was intercepted in time. RISK ASSESSMENT DOCUMENT: WHEN IT BECOMES STRATEGIC The Risk Assessment Document is no longer just a formal requirement, but the cornerstone of consistency for the entire company system. Decree Law 159/2025 reinforces the principle that risk assessment must be updated in the event of: • technological changes; • organisational changes; • the introduction of new equipment or procedures. PPE AND WORK AT HEIGHT: PRIORITY TO COLLECTIVE PROTECTION Tra le novità: • introduzione di una nuova tipologia di visita medica (art. 41, comma 2, lett. e-quater), attivabile dal Medico Competente quando vi sia un ragionevole motivo di ritenere che il lavoratore si trovi sotto l’effetto di alcol, sostanze stupefacenti o psicotrope, limitatamente alle attività ad elevato rischio infortunistico e ai soli fini della sicurezza nello svolgimento della mansione (fino a oggi nel settore ascensoristico questa visita medica non era possibile in caso di sospetta dipendenza da sostanze stupefacenti o psicotrope, ma solo per il controllo della dipendenza da alcolici); • previsione, entro dodici mesi, di un decreto del Ministro della Salute per definire i requisiti delle strutture di cui il Medico Competente può avvalersi; • rafforzamento del ruolo degli organismi paritetici, soprattutto per le imprese fino a dieci lavoratori. Il decreto ribadisce, inoltre, il ruolo centrale del Medico Competente e demanda a un Accordo Stato-Regioni l’aggiornamento delle procedure su alcol-dipendenza e tossicodipendenza. INNOVAZIONE, DPI E POLITICHE INAIL: UN QUADRO CHE CAMBIA Il decreto rafforza il ruolo dell’INAIL non solo come ente assicurativo, ma come attore attivo nella promozione della prevenzione, prevedendo: • interventi a favore delle micro, piccole e medie imprese per l’adozione di DPI innovativi e sistemi intelligenti; • risorse dedicate alla diffusione della cultura della sicurezza e alla formazione nei settori a maggiore incidenza infortunistica. NEAR MISS: LINEE GUIDA NAZIONALI Entro sei mesi dall’entrata in vigore del decreto dovranno essere adottate linee guida per l’identificazione, il tracciamento e l’analisi dei mancati infortuni per le imprese con più di 15 dipendenti. Il Ministero del Lavoro stabilirà le modalità di comunicazione dei dati aggregati e delle azioni correttive, al fine di predisporre un rapporto annuale nazionale. È un passaggio culturale importante: si sposta l’attenzione dall’evento accaduto al rischio intercettato per tempo. DVR: QUANDO DIVENTA STRATEGICO Il Documento di Valutazione dei Rischi non è più solo un adempimento formale, ma il fulcro di coerenza dell’intero sistema aziendale. Il DL 159/2025 rafforza il principio secondo cui la valutazione dei rischi deve essere aggiornata in presenza di: • modifiche tecnologiche; • cambiamenti organizzativi; • introduzione di nuove attrezzature o procedure. 44 NORMATIVA DI TLP
