INCENTIVES AND TAX BENEFITS (COMPANY WELFARE) In this scenario, the benefits that employers offer their employees are genuine insurance incentives in the form of compensation or expense reimbursements. The insurance benefits provided constitute genuine company welfare. Article 51 of the T.U.I.R. (Testo Unico Imposte sui Redditi - Consolidated Income Tax Law) in paragraph 2, letter a), establishes that contributions paid by the employer to funds, bodies or funds for welfare purposes, in accordance with the provisions of a contract, agreement or company regulations, for a total amount not exceeding €3,615.20 per year, do not contribute to the formation of income. It is important to specify that this exemption applies to contributions paid to supplementary health funds and that it applies to both company and employee contributions, even if extended to the employee’s family, with additional savings in social security contributions (INPS/ INAIL) for both parties. Company welfare plans can take various forms. Among the most popular solutions, valid for both company directors and employees, are those that include the reimbursement of healthcare expenses for both the employee and their family members. Coverage may include hospitalisation with or without surgery, diagnostics, therapies, specialist visits, cancer treatment, dental treatment, lenses and eyeglasses, prevention and telemedicine, and ticket reimbursements. It is also possible to customise the policy for the company or for individuals, provided that the criteria of collective homogeneity and professional category are met (e.g. all employees, all workers of a certain level, all members of the board of directors or all managers, etc.). PAY ATTENTION TO THE INCLUSION OF DIRECTORS AND SHAREHOLDERS The inclusion of directors and shareholders requires a specific analysis of their position. Separate policies are often used to manage their coverage, so as not to alter the criteria of collective homogeneity of the welfare plan for employees. PRACTICAL ADVICES Alongside the advantages, it is also essential to consider certain aspects in order to avoid inconvenience or problems. Check agreements and rates: It is advisable to always check, before booking, that the facility or specialist chosen is affiliated. This is the only way to be sure that the discounted rates will be applied. Reimbursement in the case of affiliated facilities and doctors: Payment for the service can be direct (the expense is paid directly by the organisation) or indirect (the worker pays for the service in advance and then requests reimbursement). Reimbursement may be total; in some cases, an excess is required. Reimbursement in the case of non-affiliated facilities and doctors: In this case, the worker pays the expense in RISCHI E ASSICURAZIONI DI ANGELO NICOLOSI*
