27 REGULATION (EU) 2023/1230 on machinery, which repeals and replaces Directive 2006/42/EC from the date of application laid down in the Regulation, introduces significant changes, including with regard to documentation management. One of the most significant changes is the option to provide the instructions for use in digital format and to make the EU declaration of conformity available digitally. However, digitalisation should not be understood as a simple replacement of the paper document with an electronic file. The Regulation sets out precise conditions regarding accessibility, long-term availability, the ability to download and store the documents, and their association with the specific machine. It is important to draw a clear distinction between documentation intended for the user and that which the manufacturer is required to prepare and retain in order to demonstrate the machine’s conformity. In particular, the instruction manual, the EU Declaration of Conformity and the technical documentation are not intended for the same audience nor do they serve the same purpose. THE INSTRUCTION MANUAL IN DIGITAL FORMAT Article 10(7) of the Regulation stipulates that machinery must be accompanied by the instructions for use and the information set out in Annex III, and permits these instructions to be provided in digital format. A manufacturer who chooses this method must indicate on the machinery, or, where this is not possible, on the packaging or in an accompanying document, how to access the digital instructions. The system used must also enable the user to print and download the instructions, save them on an electronic device and consult them at any time, in particular in the event of a machine breakdown. This requirement also applies where the instructions are integrated into the machine’s software. The digital instructions must remain accessible online throughout the machine’s intended life cycle and, in any event, for at least ten years from the date of placing on the market. Digitalisation therefore does not remove the manufacturer’s responsibility to ensure the availability of the documentation over time. A simple link to a web page that could be modified or removed without oversight would not be sufficient to ensure the proper management of the documentation. Specific protection is provided for the user: at the user’s request at the time of purchase, the manufacturer must provide the instructions for use in paper format IL Regolamento (UE) 2023/1230 relativo alle macchine, che abroga e sostituisce la Direttiva 2006/42/CE a partire dalla data di applicazione prevista dal Regolamento, introduce importanti novità anche per quanto riguarda la gestione della documentazione. Una specifica tutela è prevista per l'utilizzatore:: su richiesta dell’utilizzatore al momento ISTRUZIONI PER L’USO E DICHIARAZIONE UE DI CONFORMITÀ POSSONO DIVENTARE DIGITALI, MENTRE LA DOCUMENTAZIONE TECNICA MANTIENE FINALITÀ, DESTINATARI E MODALITÀ DI CONSERVAZIONE DIFFERENTI Instructions for use and the EU Declaration of Conformity may be provided in digital form, whilst technical documentation retains different purposes, intended recipients and methods of retention
