28 free of charge within one month. There is also a specific provision for machinery intended for non-professional users, or which may reasonably be used by such persons. In this case, the manufacturer must provide, in paper format, the essential safety information required for the putting into service and safe use of the machinery. This is a specific provision of Article 10(7), which represents a significant limitation on the complete digitisation of documentation. The principle adopted by the Regulation is therefore to promote digitalisation, whilst maintaining certain safeguards to protect the user. CONTENT AND INTENDED RECIPIENTS OF THE INSTRUCTIONS The option to provide the instructions in digital format does not alter the content that must be provided by the manufacturer. Annex III, point 1.7.4, sets out the requirements relating to the instructions for use. These must be clear, comprehensible and legible, and must take into account not only the intended use of the machinery but also any reasonably foreseeable misuse. The information required includes, where relevant, the details of the manufacturer and the authorised representative, the identification of the machinery, the EU Declaration of Conformity or the necessary information to access it, a description of the machinery, the information necessary for use, maintenance and repair, instructions for installation and connection, the intended methods of use, and warnings regarding uses that must be avoided. The instructions therefore constitute documentation intended for the user of the machinery and must be available in a form that enables the persons concerned to carry out the activities intended by the manufacturer in safety. In the case of specialised personnel appointed by the manufacturer or their authorised representative, the Regulation provides for specific rules regarding certain maintenance instructions, which may be supplied in a single official language of the Union understood by the personnel concerned. THE EU DECLARATION OF CONFORMITY As is well known, the EU Declaration of Conformity (currently known as the EC Declaration of Conformity for the Machinery Directive) serves a different purpose from the instructions. Through this document, the manufacturer declares, under its own responsibility, that the machinery complies with the applicable requirements of the Regulation and, where relevant, of other applicable Union legislative acts. Article 21 stipulates that the declaration must follow the structure set out in Annex V, Part A, and contain the required elements. The declaration must identify the machinery and state, amongst other things, the name and address of the manufacturer and, where applicable, the authorised representative, as well as references to the applicable legislation, the harmonised standards or technical specifications used and, where relevant, the notified bodies involved in the conformity assessment. dell’acquisto, il fabbricante deve fornire gratuitamente le istruzioni per l’uso in formato cartaceo entro un mese.
