* Esperto ascensori ** Direttore tecnico V.I.S. Srl *** Esperto ascensori infill panels – at a total cost of approximately 80,000 euros, the block of flats raised objections regarding the failure to carry out certain ancillary and finishing works, despite the completion report certifying that the work was substantially in accordance with the contractual provisions. The lift was commissioned as normal, did not suffer any breakdowns and was used to the satisfaction of the flat owners. The dispute was referred to the parties’ lawyers, who initially attempted to reach an amicable settlement. The installer did not deny the need for certain completion works, although not all of them were contractually required. On the contrary, he adopted a cooperative approach by putting forward two settlement proposals: to pay the owners’ association a sum of 5,500 euros by way of a settlement, or to carry out the remaining works himself. In response to this offer, the block of flats put forward further financial demands, seeking not only the sum proposed to settle the dispute but also reimbursement of legal fees and technical consultancy costs incurred, amounting to a total of more than four times the sum proposed by the contractor. As no agreement was reached, the matter was referred to the courts. This was followed by site inspections, expert assessments and further legal costs for both parties. At the conclusion of the preliminary investigation, the court-appointed technical expert deemed the sum of 5,000 euros to be appropriate, in line with the amount already offered by the installer during the out-of-court phase, whilst also highlighting the latter’s willingness to seek a swift resolution to the matter. The judge’s final decision was even more significant: the costs of the technical assessment were borne by the block of flats. From the outset, in fact, the contractor recognised the works that actually fell within its remit, and undertook to resolve the remaining issues. At the same time, it ruled out treating works not provided for in the original agreement as being due. Disputes cannot always be avoided. However, reasonableness and good faith should lead both parties to consider solutions proportionate to the scale of the issues. When these issues concern minor matters and a solution has been proposed, resorting to litigation risks incurring costs and delays that outweigh the expected benefits. Finally, this case highlights the importance of being able to rely on the support of qualified professionals, both technically and legally, who are capable of objectively assessing the disputes and effectively safeguarding the company’s legitimate rights. * Lift expert ** V.I.S.
