Published in the Official Gazette no. 277 of November 27, Law no. 167 "Provisions for the fulfillment of the obligations deriving from Italy's membership of the European Union - European Law 2017" which restores the Examining Commissions at the Prefectures for the issue of qualification for lifts maintenance staff. The law will come into force on December 12th.

In Chapter VIII, Article 23 on "Provisions for the full implementation of Directive 2014/33 / EU relating to lifts and safety components of lifts as well as for the operation of lifts" states:

  1. In order to ensure the full implementation of Directive 2014/33 / EU of the European Parliament and of the Council, of 26 February 2014, relating to lifts and safety components of lifts as well as for lifts activity, the qualification certificate provided by article 15, paragraph 1, of the regulation referred to in the Presidential decree April 30, 1999, n. 162, is valid throughout the national territory and is issued by the prefect following the favorable outcome of a theoretical-practical test before a special examining commission, appointed by the commission composed of five officials, in possession of adequate technical skills, of which at least one, in addition to the president, has a degree in engineering, designated respectively by the Ministry of Labor and Social Policies, by the Ministry of Infrastructure and Transport, by the Ministry of economic development, by the National Institute for Insurance against Accidents at Work (INAIL) and by a local health company, or by a regional agency for environmental protection, if the regional provisions implementing the decree- 496 of 4 December 1993, converted, with modifications, by law 61 of 21 January 1994, assigning this agency the competences in the matter. The commission is chaired by the official designated by the Ministry of Labor or Social Policies. At least three members of the commission are present at the theoretical-practical test, including the president. The chairman and the members of the commission are not entitled to any remuneration.
  2. The date and location of the examination sessions is determined by the prefect. The prefect of the regional capital, taking into account the number and origin of the applications received, after agreement with the other prefects of the region, may arrange for specific examination sessions for all applications presented in the region in order to rationalize the procedures aimed at issuing the certificate of qualification.
  3. Articles 6 and 7 of the regulation referred to in the decree of the President of the Republic of 24 December 1951, no. 1767, are repealed.
  4. The Government is authorized to modify, by means of a specific regulation, the regulation referred to in the decree of the President of the Republic no. 162, on the basis of the provisions of this article. On the date of entry into force of the regulation adopted pursuant to this paragraph, paragraphs 1 and 2 of this article are repealed.
