la violazione della Legge n. 13/1989 e del DM attuativo n. 236/1989, perché tali norme si applicano solo agli edifici realizzati successivamente all’entrata in vigore della legge o agli edifici preesistenti la cui integrale ristrutturazione sia successiva. L’installazione di un ascensore in edifici preesistenti viene, invece, generalmente qualificata come intervento di “manutenzione straordinaria” e, come tale, sfugge all’applicazione della normativa sopra citata. Questo aspetto è rilevante in quanto, nelle ipotesi in cui venga realizzato un ascensore in un edificio preesistente e venga effettuato il taglio delle scale al di sotto dei limiti stabiliti dal DM 236/89, si può giustificare il mancato rispetto dei requisiti tecnici del Decreto Ministeriale invocando la non applicabilità dello stesso agli interventi di “manutenzione straordinaria” come è classificabile quello di realizzazione di un ascensore, salvo che non ricada eccezionalmente nelle ipotesi di ristrutturazione (sulla distinzione tra interventi di manutenzione straordinaria e interventi di ristrutturazione si veda l’art. 3 comma 1 lett. b e d del DPR 380/01 TU Edilizia). A prescindere da quanto sopra, la Cassazione è andata oltre e ha affermato comunque che, anche se le prescrizioni tecniche delle norme sopra richiamate si dovessero applicare agli edifici preesistenti, esse sono comunque derogabili. Nel dettaglio viene, infatti, evidenziato che le prescrizioni tecniche di cui all’art. 8 del DM 236/1989 (larghezza minima rampe delle scale m. 1,20) possono essere derogate perché l’art. 7.2 sancisce espressamente che “in sede di progetto possono essere proposte soluzioni alternative alle specificazioni e soluzioni tecniche, purché rispondano ad esigenze sottintese ai criteri di progettazione”. In questo caso la dichiarazione di conformità degli elaborati alle disposizioni di cui alla Legge 13/1989 redatta dal professionista abilitato deve essere accompagnata da una “relazione corredata con grafici con la quale viene illustrata l’alternativa proposta e l’equivalente o migliore qualità degli esiti ottenibili”. Sostanzialmente si evince, quindi, che le specifiche tecniche previste dal DM, applicabili solo a nuove costruzioni o a ristrutturazioni, possono essere derogate ma è necessario che i progetti siano accompagnati da detta relazione. Inoltre, l’art. 7.5 stabilisce che negli interventi di ristrutturazione sono ammesse deroghe alle norme del decreto in caso di dimostrata impossibilità tecnica connessa ad elementi strutturali ed impiantistici. “Le suddette deroghe sono concesse dal sindaco in sede di provvedimento autorizzativo previo parere favorevole dell’ufficio tecnico o del tecnico incaricato dal Comune dell’istruttoria dei progetti”. Concludendo, sulla base di quanto sopra riportato, possiamo quindi affermare che: - la realizzazione dell’ascensore rappresenta generalmente un intervento di manutenzione straordinaria (art. 3 com- Finally, the Court - and this is of particular interest to us here - did not find that Law No 13/1989 and implementing Ministerial Decree No 236/1989 had been infringed, because those rules apply only to buildings constructed after the law came into force or to pre-existing buildings whose complete renovation is subsequent. The installation of a lift in pre-existing buildings is, on the other hand, generally qualified as an intervention of ‘extraordinary maintenance’ and, as such, escapes the application of the above-mentioned regulations. This aspect is relevant because, in the event that a lift is built in an existing building and the stairs are cut below the limits established by Ministerial Decree 236/89, one can justify the failure to comply with the technical requirements of the Ministerial Decree by invoking the non-applicability of the same to “extraordinary maintenance” interventions such as the construction of a lift, unless it falls exceptionally within the hypothesis of renovation (on the distinction between extraordinary maintenance and renovation interventions see art. 3 paragraph 1 lett. b and d of Presidential Decree 380/01 Consolidated Text for Construction). Regardless of the above, the Court of Cassation went further and affirmed, however, that even if the technical prescriptions of the above-mentioned standards were to be applied to pre-existing buildings, they can still be derogated from. In detail, in fact, it is pointed out that the technical prescriptions of Article 8 of Ministerial Decree 236/1989 (minimum width of staircase ramps m. 1.20) can be derogated from because Article 7.2 expressly states that “alternative solutions to the technical specifications and solutions may be proposed at the design stage, provided that they meet the requirements underlying the design criteria”. In this case, the declaration of conformity of the drawings with the provisions of Law 13/1989 drawn up by the qualified professional must be accompanied by a “report accompanied by graphs illustrating the alternative proposed and the equivalent or better quality of the results obtainable”. Basically, therefore, it is inferred that the technical specifications provided for by the Ministerial Decree, applicable only to new constructions or renovations, may be waived, but the projects must be accompanied by said report. Furthermore, art. 7.5 states that in renovation works, exceptions to the regulations of the decree are allowed in the case of proven technical impossibility related to structural and plant engineering elements. “The aforementioned exceptions are granted by the mayor in the authorisation measure following the favourable opinion of the technical office or the technician appointed by the municipality for the preliminary investigation of the projects”.
