The aim is to make the credit licence a truly selective tool, directly linking company behaviour and the possibility of operating. QUALITY OF TRAINING Decree Law 159/2025 significantly addresses the issue of training quality, providing for a new State-Regions Agreement that will define criteria and requirements for the accreditation of training providers. The stated objective is to raise the quality of training provision through requirements related to: • certified competence and experience; • adequate organisation; • availability of resources. The decree also explicitly promotes the use of advanced digital tools (such as simulated and augmented reality) and experiential learning, especially in dual training programmes, integrating classroom training and direct experience in the workplace. COMBATING FEIGNED TRAINING Without introducing new independent penalties, Decree Law 159/2025 strengthens the framework that allows supervisory bodies to cross-reference data, attendance, duties and training courses, thanks to the interoperability between information systems. This means that: • inconsistencies between declared training and actual activities become easier to identify; • the quality of training courses and their effective delivery take on increasing importance during audits. This is an opportunity for businesses: traceability becomes a tool for protection, not just control. MORE PROTECTION FOR STUDENTS IN THE WORKPLACE The decree strengthens INAIL (National Institute for Insurance against Accidents at Work) protection for students, structurally extending coverage to accidents while travelling to and from work. It also establishes that students cannot be assigned to high-risk tasks, as identified in the host company’s risk assessment document. This requires companies to carefully and responsibly assess the activities in which students can be involved. L’obiettivo è rendere la patente a crediti uno strumento realmente selettivo, che leghi in modo diretto comportamento aziendale e possibilità di operare. QUALITÀ DELLA FORMAZIONE Il DL 159/2025 interviene in modo significativo sul tema della qualità della formazione, prevedendo un nuovo Accordo Stato-Regioni che dovrà definire criteri e requisiti per l’accreditamento dei soggetti formatori. L’obiettivo dichiarato è innalzare il livello qualitativo dell’offerta formativa, attraverso requisiti legati a: • competenza ed esperienza certificata; • adeguata organizzazione; • disponibilità di risorse. Il decreto, inoltre, valorizza esplicitamente l’uso di strumenti digitali avanzati (come realtà simulata e aumentata) e l’apprendimento esperienziale, soprattutto nei percorsi realizzati in modalità duale, integrando formazione d’aula ed esperienza diretta in azienda. CONTRASTO ALLA FORMAZIONE DI FACCIATA Pur senza introdurre nuove fattispecie sanzionatorie autonome, il DL 159/2025 rafforza il quadro che consente agli organi di vigilanza di incrociare dati, presenze, mansioni e percorsi formativi, grazie all’interoperabilità tra i sistemi informativi. Questo significa che: • le incongruenze tra formazione dichiarata e attività svolta diventano più facilmente individuabili; • la qualità dei percorsi formativi e la loro effettiva erogazione assumono un peso crescente in sede di verifica. Per le imprese è un’opportunità: la tracciabilità diventa strumento di tutela, non solo di controllo. PIÙ TUTELE PER GLI STUDENTI IN AZIENDA Il decreto rafforza la tutela INAIL per gli studenti, estendendo in modo strutturale la copertura anche agli infortuni in itinere. Viene inoltre stabilito che gli studenti non possono essere adibiti a lavorazioni ad elevato rischio, come individuate nel DVR dell’impresa ospitante. Questo impone alle aziende una valutazione attenta e responsabile delle attività in cui è possibile coinvolgere gli studenti. SORVEGLIANZA SANITARIA E ACCERTAMENTI ALCOL/DROGHE Si rafforza il sistema della sorveglianza sanitaria intervenendo sugli articoli 25, 41 e 51 del D.Lgs. 81/2008.
